    Where San Francisco prediction markets stand legally

    Event contracts on CFTC-regulated exchanges are available to eligible Bay Area residents, and no California agency has taken enforcement action against Kalshi or Polymarket as of September 26, 2026. Two court decisions from this fall matter, though, because California sits in the Ninth Circuit.

    What happened

    • •August 28, 2026: In KalshiEX LLC v. Assad, a Ninth Circuit panel held that federal commodities law does not shield Kalshi's sports event contracts from Nevada gaming law. The court sent the question of election contracts back to the lower court. Read the opinion.
    • •September 9, 2026: Kalshi asked the full Ninth Circuit to rehear the case. A separate New Jersey dispute may also reach the Supreme Court.
    • •September 16, 2026: The Ninth Circuit sided with two California tribes, Blue Lake Rancheria and Chicken Ranch Rancheria, in their case against Kalshi. Kalshi now geofences those tribes' lands. None of them is in the Bay Area, and the ruling is not a statewide ban.

    Why it matters for Bay Area traders

    • •The Third Circuit ruled for Kalshi in a New Jersey case earlier in 2026 (see our Third Circuit ruling coverage). Two federal appeals courts now disagree, which makes Supreme Court review more likely.
    • •The Ninth Circuit ruling is precedent for federal courts in California. Nothing in it has switched off sports contracts for Bay Area users so far, but California officials now have a stronger footing if they choose to act.
    • •California Attorney General Rob Bonta joined a 37-state brief supporting Ohio's effort to apply state gambling law to Kalshi (Covers, September 23, 2026).

    Rules still moving

    • •The CFTC withdrew its 2024 event-contracts proposal on February 4, 2026, and proposed a new framework on June 10, 2026 that treats outcome-based sports contracts more favorably than contracts on injuries or officiating calls.
